Terms and Conditions

These terms and conditions of usage in this platform are to set regulations in your order of homemade food from chefs who cook in their home and can serve by this platform. By ordering food products from this platform, you are indicating your support and approval of these terms and conditions. User should agree that by ordering food, the User agrees to be bound by these Terms. Please understand that if the User refuses to accept these Terms, the User will not order any products from this platform.

Ordering

If the user has selected the food item from the menu, the user will have to Confirm the items for an order to deliver them. Please remark it is important that the user check the items added are correct and for any misunderstandings. On receiving the payment, Homeal will begin processing the order, and we will send a notification through the application that payment has been received and the order is being processed. Any payment user makes is not authorized. The user will be returned to the previous page on the app, and we shall not be obliged to provide the services. Please note that once users have made the order and payment have been authorized, you will not be able to cancel your order nor be entitled to a refund. Please note that from time to time, there may be delays with processing payments and transactions. On occasion, this can take time delay to be deducted from your bank account.

Chef Registration

By registering your details on Homeal as a Chef,

  • You are legally able of beginning into necessary contracts.
  • You are at least 18 years old.
  • You are not in any way banned by the applicable law in the jurisdiction which you are currently located to enter into these Terms for the use of the Services and purchase of homemade food or things or Home-based service offerings.
  • In order to use the Homeal application services, you will need to complete the registration process provided in the Homeal application and set up an account.
  • By registering your details and entering up your details, you allow to conducting verification and security procedures in respect of the information provided by you.
  • You now warrant that the information provided by you is true, proper, and accurate. You further ensure that you shall promptly notify the event of any changes to such information.
  • By signing up, you agree to the Terms and Conditions of Homeal.
  • Upon registration, we will allow you to join the App. However, you shall keep your registration details for the App (“Login Details”) confidential and secure. Without objection to any other rights and remedies available.
  • Homeal reserves the right to promptly disable your Login Details and check your access to the App if Homeal has any reason to believe you have breached any of the terms set out herein.
  • Notwithstanding the preceding, Homeal reserves the right to:
  • Accept or reject your application to register for any reason; and Suspend your Account and/or refuse you access to the Services and/or App if you breach any of the provisions hereunder.
Steps to be followed by Chef :
  • To follow the fixed menu format given by the company.
  • To follow the fixed prices for the given menu by the company irrespective of the items or any dish type. In case of any special item discuss it with the team and then add the menu in your kitchen
  • To only prepare and add vegetarian food items to your menu
  • Rejection of an order will be charged penalties on it.
  • Kitchen not being available for a longer period of time will cause to deactivation of the account.
  • If items mentioned in the order were not sent to the customer or got misplaced by another item we will be charging it to the chef.
  • To handle the right parcel to the delivery person so it doesn’t recreate any confusion during delivery.
User Registration
  • To create a Profile page
  • Ability to search for Home Chef and their food who have registered with the App and have Meals available for Order
  • Ability to communicate with other Users and Home Chefs using the App.
  • Review and rate the Home Chef or their dishes.
  1. You acknowledge and agree that all Orders are to be approved by the Home Chefs. We are not responsible for either party’s performance under any contract and no guarantee that the obligations of either party under the contract will be fulfilled.
  2. All food items sold on the App are perishable. Therefore cancellations or refunds may not be permitted by Home Chef.
  3. In the case of payment done by the user and the Order is not fulfilled by the Home Seller for some reasons. In such cases, we will examine the issue with the Home Chef.
User Obligations
  • You agree that you are solely responsible and liable for all activities carried out by your use of the App
  • You shall not submit to appear on the App through your use of the Services, any report, reviews, comments, images, third party URL links, or other material whatsoever in any format, whether within your Profile
  • You shall not submit a rating or a review concerning another User or Home Seller with reasonable opinion, it may be deemed to be offensive, illegal, inappropriate.
  • You shall not promote racism, bigotry, hatred, or physical harm of any kind against any group or individual.
  • You shall not promote any conduct that is abusive, threatening, obscene, defamatory, or libelous.
  • You shall not promote any illegal activities.
  • You shall not infringe any rights of any third party.
  • Co-operate with any reasonable safety or other checks or requests for information made by Homeal from time to time
  • Use the information made available to you on the App and through the Services at your own risk.
Cancellation Policy

There is no guarantee for food delivery at a particular time period. If a customer cancels the order or does not accept the order due to a delay in food delivery, no refund will be processed by us.
Due to unforeseen situations, bad weather, etc., if we cannot deliver the food to your address, you will not be charged for the order.
If you choose to cancel your order, you must notify within the Home chef’s order time period. In such a case, no cancellation fees shall apply. If the cancellation is done post Chef’s order taking time, your order may not be cancelled with no refund.

Subscription Policy

Subscription Policies are held based on checking on your requirement and finding a near by chef for you. If Both parties agree that the process starts where we will be assigning a chef to the customer. Subscription starts , where orders are getting created based on the respective dates of payment held.

When your subscription is expired , user should renew it within a week. Else a new subscription has to be created and if there are any changes accept it accordingly.

Eligibility

The Application and Service are intended solely for the user who is 18years and above. Therefore, you represent and warrant that you are 18year and above by accessing or using this service

The participant user , whoever as Chef should be approved based on the criteria set by the organization. Certain verification procedures are handled during the onboarding process if all the procedures are approved than you are eligible as Home chef in our platform.

On certain periods there will be a recheck of your performance so we can guide and train you so you develop your skills and maintain it well.

Agreement

These terms and conditions and any certificate expressly applied to in them develop the whole contract between us and succeed all previous proposals, communication, discussions, previous arrangement, understanding, or negotiation between us relating to the subject matter of any agreement
